EFOA Terms and Conditions of Website Use

This website (the “Site”) is operated by the European Federation of Ocularists and Anaplastologists (“EFOA”, “we”, “us”, or “our”). By accessing or using this Site, you agree to be bound by these Terms and Conditions of Use (the “Terms”).

If you do not agree, you must not use this Site.

We may revise these Terms from time to time by updating this page. Your continued use constitutes acceptance of the revised Terms.

1. Intellectual Property Rights

1.1 All content on this Site, including text, graphics, images, videos, logos, trademarks, publications, LMS materials, conference recordings, and any other works, are owned by or licensed to EFOA and are protected by EU copyright law and international treaties.

1.2 Any material posted on the Learning Management System (LMS)/ Membership Portal is the sole property of EFOA. Members acknowledge that any materials they produce, upload, or publish in relation to projects for or related to EFOA whether on our LMS or any other platforms, automatically become our intellectual property, with full copyright vested in us.

1.3 You may view and download material for personal, non-commercial use only. You must not reproduce, modify, distribute, or commercially exploit any content without prior written consent.

1.4 Our names, logos, trademarks, and service marks may not be used in any way, including advertising or publicity, without our express written consent.

2. Membership

2.1 Membership is subject to separate Membership Terms and Conditions. By becoming a member, you agree to those terms.

2.2 Members act solely in their personal capacities. Membership with EFOA does not create, and shall not be construed as creating, any employment, agency, partnership, joint venture, fiduciary, franchise, representative, or any other legal relationship whatsoever between the member and EFOA. Members participate solely in their individual capacity and remain personally responsible for their own actions.

2.3 Members are personally liable for their statements, actions, and representations, even if they reference their membership. Misuse of our name, logo, or affiliation is strictly prohibited and members remain fully liable in their personal capacity.

2.4 For the purposes of these terms and conditions, a Member is any individual or entity that has applied for and been accepted into membership of the European Federation of Ocularists (EFOA), has paid the applicable membership fee, and has agreed to abide by the Membership Terms and Conditions.

Membership provides access to EFOA’s resources, activities, services, and platforms (including the Learning Management System, patient referral system, publications, and conferences), subject to the limitations set out in any of the Terms.

Membership is personal and non-transferable. Membership grants only rights to participate in EFOA’s activities but does not confer any ownership, control, or legal interest in EFOA, nor any right to represent EFOA in any capacity.

3. Patient Referral Page

3.1 We may provide a referral service to connect patients with healthcare professionals who are members of our organisation.

3.2 We do not provide medical services, diagnosis, or treatment. Referrals are purely informational and do not constitute medical advice.

3.3 Patients are solely responsible for conducting their own due diligence before engaging with any healthcare professional.

3.4 Doctors remain fully liable for their own patients and treatments, regardless of referral.

3.5 We disclaim all liability for any relationship, treatment, or outcome between patients and referred professionals.

4. Conferences and Seminars

4.1 We host professional conferences, seminars, and internal meetings. These are intended for professional discussion, networking, and knowledge sharing.

4.2 Any information, presentations, or materials shared at conferences are for informational purposes only and do not constitute professional, medical, or legal advice.

4.3 Attendees are solely responsible for how they use information obtained during such events.

4.4 We bear no liability for any reliance placed on information shared at conferences or seminars.

5. Learning Management System (LMS)

5.1 Access to the LMS is provided exclusively to members and enrolled students.

5.2 All content on the LMS, including recorded lectures, slides, study materials, and assessments, is the property of EFOA.

5.3 Any content created or uploaded by members to the LMS automatically becomes the intellectual property of EFOA. Members waive any moral or financial rights to such materials.

5.4 LMS content is for educational purposes only and does not constitute advice. We disclaim liability for any reliance placed upon it.

6. Publications Page

6.1 Our Publications Page contains articles, research papers, and contributions from members.

6.2 These publications are for informational purposes only. They do not constitute advice of any kind.

6.3 We publish works of our members but accept no responsibility or liability for their accuracy, reliability, or opinions expressed therein.

7. Eye Donation Page and Donations Policy

7.1 We may accept donations intended to support specific causes or patient aid. Donations will be processed in accordance with our Donations Policy, which ensures funds are directed to intended purposes.

7.2 Applicants for financial aid consent to their data being processed under our Privacy Policy.

7.3 We will make reasonable efforts to distribute funds properly, but we do not guarantee outcomes or assume responsibility for the work of any healthcare professionals involved.

7.4 Patients remain fully responsible for conducting due diligence on doctors and may request alternative referrals.

7.5 We disclaim all liability for medical services arising out of or connected with donations or referrals.

8. Disclaimers and Liability

8.1 This Site and all its content are provided on an “as is” and “as available” basis, without warranties of any kind.

8.2 To the maximum extent permitted by law, we disclaim all liability for:

reliance on information from the Site, LMS, publications, referrals, or conferences and all other activities related to EFOA;
actions or omissions of members or third-party professionals;
direct, indirect, incidental, special, or consequential damages, including loss of profits, goodwill, or data.

8.3 Use of this Site, our LMS, publications, conferences, or referrals and any other activities or services is entirely at your own risk.

9.1 This Site may contain links to third-party websites. These are provided for convenience only.

9.2 We have no control over such websites and disclaim all responsibility for their content or policies.

10. Privacy

Personal data is collected and processed in accordance with our Privacy Policy, which forms part of these Terms.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus.

11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.

12. Entire Agreement

12.1 These Terms constitute the entire agreement between you and EFOA regarding use of the Site.

12.2 Any invalid provision shall not affect the validity of the remaining Terms.

12.3 By accessing or using our Website, Services, membership benefits, or participating in any related EFOA activities, you are deemed to have accepted and agreed to be bound by these Terms and Conditions as well as all other applicable EFOA policies, guidelines, and rules (as amended from time to time).
